if it were not for a word I heard from ʿAmr ibn al-Ḥamq al-Khuzāʿī, I would have walked between al-Mukhtār's head and his body. I heard him say: The Messenger of Allāh (ṣallá Allāhu ʿalayhi wa-sallam) said: and he mentioned it. This is an authentic chain, and its narrators are trustworthy as mentioned in "al-Zawāʾid" because Rafāʿah ibn Shaddād al-Qitbānī - with a kasrah on the qāf and a sukūn on the thāʾ - was deemed reliable by al-Nasāʾī, and Ibn Ḥibbān mentioned him in "al-Thiqāt," and the rest of the chain's narrators are those of Muslim. In a version by al-Nasāʾī: "When a man trusts another man and then kills him, a banner is raised for him..." It was also reported with the wording: "Whoever grants a man safety for his blood and then kills him, I am free from the killer, even if the killed was a disbeliever." It was recorded by al-Bukhārī in "al-Tārīkh," al-Ṭaḥāwī in "al-Mushkil" (1/78), al-Kharāʾiṭī, and al-Ṭabarānī in "al-Ṣaghīr" (p. 9, 121), and Abū Nuʿaym in "al-Ḥilyah" (9/24) through routes from al-Suddī from Rafāʿah ibn Shaddād with it. This is a good chain, its narrators are trustworthy except for al-Suddī, who is Ismāʿīl ibn ʿAbd al-Raḥmān, and he is truthful but makes mistakes, as mentioned in "al-Taqrīb." It was also recorded by al-Ṭayālisī (p. 181, no. 1285): Muḥammad ibn Abān narrated to us from al-Suddī with it in the wording: "When a man grants another man safety for himself," and the rest is the same. Ibn Ḥibbān also narrated it in "Ṣaḥīḥ" (no. 1682 - Mawārid) with the wording: "Whichever man grants another man safety," and the rest is the same, and it is also in "al-Musnad" (5/223-224) without the phrase: "even if the killed was a disbeliever." It has a corroborating narration from Muʿādh ibn Jabal, raised [to the Prophet] with it
لولا كلمة سمعتها من عمرو بن الحمق الخزاعي لمشيت فيها بين رأس المختار وجسده، سمعته يقول: قال رسول الله ﷺ: فذكره. وهذا سند صحيح ورجاله ثقات كما في " الزوائد " لأن رفاعة بن شداد القتباني - بكسر القاف وسكون المثناة - وثقه النسائي وذكره بن حبان في " الثقات " وباقي رجال الإسناد رجال مسلم. وفي لفظ للنسائي: " إذا اطمأن الرجل إلى الرجل ثم قتله رفع له لواء ... ". وورد بلفظ: " من أمن رجلا على دمه فقتله فأنا برىء من القاتل، وإن كان المقتول كافرا ". أخرجه البخاري في " التاريخ " والطحاوي في " المشكل " (١ / ٧٨) والخرائطي والطبراني في " الصغير " (ص ٩، ١٢١) وأبو نعيم في " الحلية " (٩ / ٢٤) من طرق عن السدي عن رفاعة بن شداد به. وهذا سند حسن، رجاله ثقات غير السدي وهو إسماعيل بن عبد الرحمن وهو صدوق يهم. كما في " التقريب ". وأخرجه الطيالسي (ص ١٨١ رقم ١٢٨٥) : حدثنا محمد بن أبان عن السدي به بلفظ: " إذا أمن الرجل الرجل على نفسه " والباقي مثله سواء. ورواه ابن حبان في " صحيحه " (رقم ١٦٨٢ - موارد) بلفظ: " أيما رجل أمن رجلا " والباقي مثله، وكذلك هو في " المسند " (٥ / ٢٢٣ - ٢٢٤) دون قوله: " وإن كان المقتول كافرا ". وله شاهد من حديث معاذ بن جبل مرفوعا به.
