with charity, so ʿAmrah bint Rawāḥah said: I will not be satisfied until you have the Messenger of Allāh (ṣallá Allāhu ʿalayhi wa-sallam) witness it. He said: "Do you have any other sons?" He said: Yes. He said: "Did you give all of them the same as you gave [this one]?" He said: No. He said: "This is injustice; do not make me a witness to it. Fear Allāh..." the ḥadīth. I said: Its narrators are trustworthy, the narrators of Muslim, except for ʿAlī ibn ʿĀṣim, who is truthful but makes mistakes and persists, as the ḥāfiẓ said. However, he has been followed up, as it was recorded by Muslim (5/66-67), Abū Dāwūd (3542), Ibn Ḥibbān (5084/al-Iḥsān), al-Ṭaḥāwī in "Sharḥ al-Maʿānī" (2/243-244 and 244), al-Bayhaqī (6/177-178 and 178), and Aḥmad (4/270) through various chains from Dāwūd ibn Abī Hind from al-Shaʿbī and Ismāʿīl ibn Sālim and Mujālid—according to Aḥmad—all three from al-Shaʿbī with a similar narration, and in the ḥadīth of Dāwūd: Then he said: "Would it please you if they were equal to you in righteousness?" He said: Yes, he said: "Then no [do not do it]." And Mujālid mentioned in his ḥadīth: "They have a right over you to be just among them, just as you have a right over them to be dutiful to you." And it was recorded by al-Ṭayālisī in "Musnad" (1/107/789), and through his route: al-Bayhaqī (6/177): Shuʿbah narrated to us from Mujālid with it. And al-Bayhaqī said: "Mujālid was unique in this wording."
بصدقة، فقالت عمرة بنت رواحة: لا أرضى حتى تشهد عليها رسول الله ﷺ؟ فقال: "ألك بنون غيره؟". قال: نعم. قال: "فكلهم أعطيت مثلما أعطيت؟". قال: لا. قال: "هذا جور؛ فلا تشهدني عليه، اتقوا الله ... " الحديث. قلت: ورجاله ثقات رجال مسلم؛ غير علي بن عاصم، وهو صدوق يخطئ ويصر، كما قال الحافظ. ولكنه قد توبع، فأخرجه مسلم (٥/٦٦-٦٧)، وأبو داود (٣٥٤٢)، وابن حبان (٥٠٨٤/الإحسان)، والطحاوي في "شرح المعاني" (٢/٢٤٣- ٢٤٤ و ٢٤٤)، والبيهقي (٦/١٧٧-١٧٨و١٧٨)، وأحمد (٤/٢٧٠) من طرق عن داود بن أبي هند عن الشعبي وإسماعيل بن سالم ومجالد- عند أحمد- ثلاثتهم عن الشعبي به نحوه، وفي حديث داود: ثم قال: "أيسرك أن يكونوا إليك في البر سواء؟"، قال: بلى، قال: "فلا إذن". وذكر مجالد في حديثه: "إن لهم عليك من الحق أن تعدل بينهم، كما أن لك عليهم من الحق أن يَبَرُّوك". وأخرجه الطيالسي في "مسنده" (١/١٠٧/٧٨٩)، ومن طريقه: البيهقي (٦/١٧٧): ثنا شعبة عن مجالد به. وقال البيهقي: "تفرد مجالد بهذه اللفظة".
