(Note): The complete chain of transmission in "al-Muʿjam" is as follows: "Mūsá ibn Hārūn narrated to us: Saʿd ibn ʿAbd Allāh ibn ʿAbd al-Ḥakam narrated to us: My father narrated to us..." etc. In the printed version of "Majmaʿ al-Baḥrayn" (3/378), (Saʿd ibn) was omitted from the chain, and the editor left a blank space in its place! This is strange; for he referred to the original source, indicating the volume and page, from which I have quoted, and it appears to me that he was unable to read the name (Saʿd); as it is not very clear in the original—which is a photocopy—and if that is the case, he should have sought assistance from the biography of his father; for he would find that among those who narrated from him is this son, and since he did not do so; why did he omit the relational term: (ibn) which is apparent?!! The mentioned exception in this path has support from the mursal of Ṭāriq ibn ʿAbd al-Raḥmān al-Qurashī who said: Rafāʿah ibn Rāfiʿ came to the assembly of the Anṣār and said: The Messenger of Allāh (ṣallá Allāhu ʿalayhi wa-sallam) forbade us today... He mentioned some things and said: He forbade us from the earnings of a slave woman except what she does with her hands—and he gestured like this with his finger—such as spinning, baking, and embroidery." It was recorded by Abū Dāwūd (3426), and al-Bayhaqī. I say: It is a mursal with a good chain of transmission, which strengthens the exception in the connected ḥadīth of Abū Hurayrah, especially since it has also been reported in a connected form through the route of Ibn Abī Fudayk from ʿUbayd Allāh ibn Ḥurayr from his father from his grandfather Rāfiʿ ibn Khadīj who said: "The Messenger of Allāh (ṣallá Allāhu ʿalayhi wa-sallam) forbade the earnings of a slave woman until it is known from where it comes?" It was also recorded by Abū Dāwūd (3427), al-Bayhaqī, and likewise by al-Ḥākim (2/42) as a supporting evidence
(تنبيه): تمام إسناده في "المعجم "هكذا: "حدثنا موسى بن هارون: ثنا سعد ابن عبد الله بن عبد الحكم: ثنا أبي ... " إلخ. فسقط من إسناده في "مجمع البحرين "المطبوع (٣/٣٧٨): (سعد بن)، وترك محققه بياضاً مكانه! وهذا غريب؛ فإنه قد أحال به إلى الأصل الذي يرجع إليه مشيراً إلى المجلد والورقة، وهو الذي نقلت منه، ويظهر لي أنه لم يتمكن من قراءة اسم (سعد)؛ فإنه غير ظاهر جدّاً في الأصل- وهو مصور-، وإذا كان كذلك، فكان عليه أن يستعين بترجمة أبيه؛ فإنه سيجد فيها أن من الرواة عنها ابنه هذا، وإذ لم يفعل؛ فلم أسقط أداة النسبة: (ابن) وهو ظاهر؟!! والاستثناء المذكور في هذه الطريق؛ له شاهد من مرسل طارق بن عبد الرحمن القرشي قال: جاء رفاعة بن رافع إلى مجلس الأنصار فقال: لقد نهانا رسول الله ﷺ اليوم ... فذكر أشياء وقال: نهانا عن كسب الأمة إلا ما عملت بيدها- وقال هكذا بإصبعه- نحو المغزل، والخبز، والنَّقش ". أخرجه أبو داود (٣٤٢٦)، والبيهقي. قلت: وهو مرسل حسن الإسناد، يتقوى به الاستثناء في حديث أبي هريرة الموصول، ولا سيما وقد جاء موصولاً من طريق ابن أبي فُدَيك عن عبيد الله بن هُريرٍ عن أبيه عن جده رافع بن خَد يج قال: "نهى رسول الله ﷺ -عن كسب الأمة حتى يعلم من أين هو؟ ". أخرجه أبو داود أيضاً (٣٤٢٧)، والبيهقي، وكذا الحاكم (٢/٤٢) شاهداً.
