it was recorded by Ibn Abī Shaybah (6/82/347), and Aḥmad (2/180). Muḥammad ibn ʿAjlān also followed it with a similar narration, and his wording is: that the Prophet (ṣallá Allāhu ʿalayhi wa-sallam) was asked about the hanging fruit, and he said: "Whoever takes from it out of need without taking it away in a cloth; there is nothing upon him." It was recorded by a group, among them al-Tirmidhī (1289), who said: "This is a ḥadīth ḥasan." There is a supporting narration that is mawqūf, narrated by Mujāhid from Abū ʿIyāḍ who said: ʿUmar said: "If you pass by a garden, eat, but do not take it away in a cloth." It was recorded by Ibn Abī Shaybah (6/83/350), and al-Bayhaqī (9/359) through two chains from Manṣūr from Mujāhid with it. I said: This isnād is ṣaḥīḥ as al-Bayhaqī said. He also said: "It is considered by us to apply in cases of necessity. And Allāh knows best." I said: This means, or its implication is, that it is not permissible to enter the wall or the garden except out of necessity. Among the evidences are several narrations presented by al-Bayhaqī, including the saying of the Prophet (ṣallá Allāhu ʿalayhi wa-sallam): "...and if you come upon the wall of a garden, call out to the owner of the garden three times. If he answers you, [then seek permission], otherwise, eat, but do not cause damage, and in another narration: and do not carry [anything away]." Its isnād is good, and it is recorded in "al-Irwāʾ" (2521). Then, as for the narration of ʿUmar: it was narrated by ʿAbd al-Razzāq (10/223/18918) with another broken chain.
أخرجه ابن أبي شيبة (٦/٨٢/٣٤٧) ، وأحمد (٢/١٨٠) .وتابعه محمد بن عجلان به، ولفظه:أن النبي ﷺ سئل عن الثمر المعلق؟ فقال:"من أصاب منه من ذي حاجة غير متخذ خُبْنَةً؛ فلا شيء عليه ". أخرجه جمع منهم الترمذي (١٢٨٩) وقال:"هذا حديث حسن ". وله شاهد موقوف، يرويه مجاهد عن أبي عياض قال: قال عمر:"إذا مررت ببستان فكل ولا تتخذ خبنة". أخرجه ابن أبي شيبة (٦/٨٣/٣٥٠) ، والبيهقي (٩/٣٥٩) من طريقين عن منصور عن مجاهد به. قلت: وهذا إسناد صحيح كما قال البيهقي. وقال:"وهو عندنا محمول على حال الضرورة. والله أعلم ". قلت: وهذا معناه أو لازمه: أنه لا يجوز أن يدخل الحائط أو البستان إلا للضرورة، ومن الأدلة روايات عديدة ساقها البيهقي، منها قوله ﷺ:".. وإذا أتيت على حائط بستان؛ فنادِ صاحب البستان ثلاث مرات، فإن أجابك، وإلا؛ فكل، غير أن لا تفسد، وفي رواية: ولا يحملن ". وإسناده جيد، وهو مخرج في "الإرواء" (٢٥٢١) .ثم إن أثر عمر: رواه عبد الرزاق (١٠/٢٢٣/١٨٩١٨) بسند آخر منقطع.
