as for Maʿqil, there is some discussion regarding his memory, as the ḥāfiẓ stated in "al-Taqrīb": "Truthful but makes mistakes." He contradicted Ibn Lahīʿah in saying: "from Abū al-Zubayr, Jābir informed him," and in saying: "al-Madīnah" instead of "Makkah." It is difficult to prefer one statement over the other, and perhaps the preferable approach is to reconcile between them. As for Ibn Lahīʿah's statement: "al-Madīnah," it is supported by two witnesses: the first is from the ḥadīth of Anas ibn Mālik with the wording: "al-Madīnah is a sanctuary from such and such, whoever introduces an innovation there, or shelters an innovator, upon him is the curse of Allāh, the angels, and all people, Allāh will not accept from him any obligatory or voluntary act, and no weapon is to be carried there for fighting." It was narrated by Aḥmad (3/242) and its men are trustworthy, the men of Muslim except for Muʾammal, who is Ibn Ismāʿīl, and al-Haythamī said (3/302): "He is reliable, but there is some discussion about him." The other is from the ḥadīth of ʿAlī, similar to the good ḥadīth from Ibn Lahīʿah, and it includes: ".. and no weapon is to be carried there for fighting." It was narrated by Aḥmad and others with a sound chain, and it is referenced in "al-Irwāʾ" (4/250-251) and strengthened by the ḥāfiẓ in "al-Fatḥ" (4/85). As for Maʿqil's statement, it is supported by the ḥadīth of Ibn ʿAbbās, raised to the Prophet: "Indeed, Allāh sanctified Makkah, and it was not permissible for anyone before me, nor will it be permissible for anyone after me..." the ḥadīth. It was narrated by al-Bukhārī and others, and it is referenced there (4/248-249) and a similar ḥadīth
ومعقل هذا فيه كلام من قبل حفظه، قال الحافظ في "التقريب": "صدوق يخطىء". فقد خالف ابن لهيعة في قوله: "عن أبي الزبير أخبره جابر"، وقوله: "المدينة" مكان "مكة". ومن الصعب ترجيح أحد القولين على الآخر، ولعل الراجح الجمع بينهما. أما قول ابن لهيعة: "المدينة"، فلأن له شاهدين: أحدهما: من حديث أنس بن مالك بلفظ: "المدينة حرم من كذا إلى كذا، من أحدث فيها حدثا، أو آوى محدثا، فعليه لعنة الله والملائكة والناس أجمعين، لا يقبل الله منه صرفا ولا عدلا، لا يحمل فيها سلاح لقتال". أخرجه أحمد (٣ /٢٤٢) ورجاله ثقات رجال مسلم غير مؤمل، وهو ابن إسماعيل، قال الهيثمي (٣ /٣٠٢): "وهو موثق، وفيه كلام". والآخر: من حديث علي نحو حديث حسن عن ابن لهيعة، وفيه: ".. ولا يحمل فيها السلاح لقتال". أخرجه أحمد وغيره بسند صحيح، وهو مخرج في "الإرواء" (٤ / ٢٥٠ - ٢٥١) وقواه الحافظ في "الفتح" (٤ / ٨٥). وأما قول معقل، فيشهد له حديث ابن عباس مرفوعا: "إن الله ﷿ حرم مكة، فلم تحل لأحد قبلي، ولا تحل لأحد بعدي.. " الحديث. رواه البخاري وغيره، وهو مخرج هناك (٤ / ٢٤٨ - ٢٤٩) ومثله حديث.
