147) From the narration of Saʿīd ibn Abī Maryam who said: ʿAbd al-ʿAzīz ibn Muḥammad al-Darāwardī informed us, saying: Dāwūd ibn Ṣāliḥ informed us from Sālim ibn ʿAbd Allāh ibn ʿUmar from his father: that Abū Bakr al-Ṣiddīq and ʿUmar ibn al-Khaṭṭāb and some people from the Companions of the Messenger of Allāh (ṣallá Allāhu ʿalayhi wa-sallam) sat after the death of the Messenger of Allāh (ṣallá Allāhu ʿalayhi wa-sallam), and they discussed the gravest of major sins, but they had no knowledge [to conclude upon], so they sent me to ʿAbd Allāh ibn ʿAmr ibn al-ʿĀṣ to ask him about that, and he informed me: Indeed, the gravest of major sins is drinking wine. So I came to them and informed them, but they denied that, and they all rushed to him, [until they came to him in his house] and he informed them that the Messenger of Allāh (ṣallá Allāhu ʿalayhi wa-sallam) said: and he mentioned it. Al-Ṭabarānī said: "It is not narrated from ʿAbd Allāh ibn ʿUmar from ʿAbd Allāh ibn ʿAmr except through this isnād, and al-Darāwardī is unique in narrating it." Al-Ḥākim said—and the addition is his: "Authentic according to the criteria of Muslim"! Thus he said, and there is what follows, and al-Mundhirī said (3 / 184): "It was narrated by al-Ṭabarānī with an authentic isnād and al-Ḥākim, and he said: Authentic according to the criteria of Muslim." I said: No, rather it is only authentic, for Dāwūd ibn Ṣāliḥ is not among the men of Muslim at all, and thus al-Haythamī said (5 / 68): "It was narrated by al-Ṭabarānī in 'al-Awsaṭ', and its men are the men of 'the authentic', except for Ṣāliḥ ibn Dāwūd al-Tammār, and he is trustworthy." The first story has been narrated between a woman and a devout worshiper, where she gave him the choice between killing a boy, committing adultery, or drinking wine, so he drank wine, committed adultery, and killed the boy. It has been narrated both as marfūʿ and mawqūf, and it is preserved as I have clarified in my commentary on "al-Aḥādīth al-Mukhtār" (320 and 349 - 350)
١٤٧) من طريق سعيد بن أبي مريم قال: أنبأنا عبد العزيز بن محمد الدراوردي قال: أخبرنا داود ابن صالح عن سالم بن عبد الله بن عمر عن أبيه: أن أبا بكر الصديق وعمر بن الخطاب وناسا من أصحاب رسول الله ﷺ جلسوا بعد وفاة رسول الله ﷺ، فذكروا أعظم الكبائر، فلم يكن عندهم فيها علم [ينتهون إليه]، فأرسلوني إلى عبد الله بن عمرو بن العاص أسأله عن ذلك، فأخبرني: إن أعظم الكبائر شرب الخمر. فأتيتهم فأخبرتهم، فأنكروا ذلك، ووثبوا إليه جميعا، [حتى أتوه في داره] فأخبرهم أن رسول الله صلى الله عليه وسلم قال: فذكره. وقال الطبراني: " لا يروى عن عبد الله بن عمر عن عبد الله بن عمرو إلا بهذا الإسناد، تفرد به الدراوردي ". وقال الحاكم - والزيادة له -: " صحيح على شرط مسلم "! كذا قال وفيه ما يأتي، وقال المنذري (٣ / ١٨٤): " رواه الطبراني بإسناد صحيح والحاكم، وقال: صحيح على شرط مسلم ". قلت: كلا، بل هو صحيح فقط، فإن داود بن صالح ليس من رجال مسلم مطلقا، ولذا قال الهيثمي (٥ / ٦٨): " رواه الطبراني في " الأوسط "، ورجاله رجال " الصحيح "، خلا صالح بن داود التمار، وهو ثقة ". وقد رويت القصة الأولى بين امرأة وعابد خيرته بين قتل غلام أو الزنا أو شرب الخمر، فشرب الخمر وزنى وقتل الغلام. روي مرفوعا وموقوفا، وهو المحفوظ كما بينته في تعليقي على " الأحاديث المختار " (٣٢٠ و ٣٤٩ - ٣٥٠).
