of their ability, and Allāh does not burden a soul beyond its capacity. The command to make up [the fast] has not been established, as previously indicated. We believe it is incumbent upon Islamic governments to unify their day of fasting and their day of breaking the fast, just as they unify their day of pilgrimage. Until they agree on this, we do not see that their people should be divided among themselves, with some fasting with their own country and others with another country. This is to avert a greater harm with a lesser harm, as established in the principles of jurisprudence. And Allāh, the Exalted, is the source of success.
استطاعته، ولا يكلف الله نفسا إلا وسعها، والأمر بالقضاء لم يثبت كما سبقتالإشارة إليه. ونرى أن من الواجب على الحكومات الإسلامية أن يوحدوا يومصيامهم ويوم فطرهم، كما يوحدون يوم حجهم، ولريثما يتفقون على ذلك، فلا نرىلشعوبهم أن يتفرقوا بينهم، فبعضهم يصوم مع دولته، وبعضهم مع الدولة الأخرى،وذلك من باب درء المفسدة الكبرى بالمفسدة الصغرى كما هو مقرر في علم الأصول. والله تعالى ولي التوفيق.
"If you had not measured it, you would have eaten from it, and it would have sufficed you." This was recorded by Muslim (7/60) through the route of Maʿqil from Abū al-Zubayr from Jābir that a man came to the Prophet (ṣallá Allāhu ʿalayhi wa-sallam) asking for food, so he gave him half a wasq of barley. The man, his wife, and their guest continued to eat from it until he measured it. He then came to the Prophet (ṣallá Allāhu ʿalayhi wa-sallam) and mentioned it. Ibn Lahīʿah corroborated it: Abū al-Zubayr narrated it to us. It was recorded by Aḥmad (3/337, 347) through two routes from him. Ḥassān ibn ʿAbd Allāh contradicted them, saying: Ibn Lahīʿah narrated to us: Yūnus ibn Yazīd narrated to us: Abū Isḥāq narrated from Saʿīd ibn al-Ḥārith from his grandfather Nawfal ibn al-Ḥārith ibn ʿAbd al-Muṭṭalib that he sought assistance from the Messenger of Allāh (ṣallá Allāhu ʿalayhi wa-sallam) for marriage, so he married him to a woman. He sought something but did not find it, so the Messenger of Allāh (ṣallá Allāhu ʿalayhi wa-sallam) sent Abū Rāfiʿ and Abū Ayyūb with his armor to pawn it with a Jewish man for thirty sāʿs of barley. The Messenger of Allāh (ṣallá Allāhu ʿalayhi wa-sallam) gave it to me, and we ate from it for half a year, then we measured it and found it as we had put it in. Nawfal said: I mentioned that to the Prophet (ṣallá Allāhu ʿalayhi wa-sallam), and he said: He mentioned it except that he said, "as long as you live" instead of "and it would have sufficed you." It was recorded by al-Ḥākim (3/246) and from him by al-Bayhaqī in "al-Dalāʾil" (6/114). Al-Ḥākim and al-Dhahabī remained silent about it. Ibn Lahīʿah has weakness due to his memory, and Abū
