"a ḥadīth ḥasan." and I say: rather, it is authentic, for Jarīr corroborated it from al-Ḥasan ibn ʿUbayd Allāh with the second wording, except that he said "disbelief" without doubt. It was recorded by al-Ḥākim, who said: "Authentic according to the criteria of the two shaykhs," and al-Dhahabī agreed with him. I said: it is only according to the criteria of Muslim, for this al-Ḥasan—who is al-Nakhaʿī—was not recorded by al-Bukhārī. However, he has been corroborated as will be mentioned. ʿAbd al-Raḥīm ibn Sulaymān also corroborated it from al-Ḥasan. It was recorded by Ibn Ḥibbān (1177), and in it: "A man swore by the Kaʿbah, and Ibn ʿUmar said: Woe to you, do not do that, for I heard the Messenger of Allāh (ṣallá Allāhu ʿalayhi wa-sallam) say: 'Whoever swears by other than Allāh has committed shirk.'" Then it was recorded by Aḥmad (2/34, 69, 86) and al-Ṭaḥāwī in "Mushkil al-Āthār" (1/357-359) and al-Baghawī (925) through other routes from Saʿd ibn ʿUbaydah with it, and in one wording for Aḥmad: "Whoever swears by anything other than Allāh the Exalted has committed shirk." Its isnād is authentic according to the criteria of the two shaykhs, and in "al-Musnad" there is another route from Ibn ʿUmar, so see "al-Irwāʾ" (2627). (Benefit): Abū Jaʿfar al-Ṭaḥāwī said: "He did not mean by it the shirk that expels one from Islam to the extent that its doer is outside of Islam, but rather he intended that it is not appropriate to swear by other than Allāh the Exalted because whoever swears by other than Allāh
" حديث حسن ". وأقول: بل هو صحيح، فقد تابعه جرير عن الحسن بن عبيد الله به باللفظ الثاني، إلا أنه قال: " كفر " ولم يشك. أخرجه الحاكم، وقال: " صحيح على شرط الشيخين "، ووافقه الذهبي. قلت: وإنما هو على شرط مسلم، فإن الحسن هذا - وهو النخعي - لم يخرج له البخاري. ولكنه قد توبع كما يأتي. وتابعه عبد الرحيم بن سليمان عن الحسن به. أخرجه ابن حبان (١١٧٧) ، وفيه: " أن رجلا حلف بالكعبة، فقال ابن عمر: ويحك لا تفعل فإني سمعت رسول الله ﷺ يقول: " من حلف بغير الله فقد أشرك ". ثم أخرجه أحمد (٢ / ٣٤، ٦٩، ٨٦) والطحاوي في " مشكل الآثار " (١ / ٣٥٧ - ٣٥٩) والبغوي (٩٢٥) من طرق أخرى عن سعد بن عبيدة به وفي لفظ لأحمد: " من حلف بشيء دون الله تعالى فقد أشرك ". وإسناده صحيح على شرط الشيخين وله في " المسند " طريق أخرى عن ابن عمر، فانظر " الإرواء " (٢٦٢٧) . (فائدة) : قال أبو جعفر الطحاوي: " لم يرد به الشرك الذي يخرج من الإسلام حتى يكون به صاحبه خارجا عن الإسلام، ولكنه أراد أنه لا ينبغي أن يحلف بغير الله تعالى لأن من حلف بغير الله
