I said: The more likely opinion is that it refers to the drum, as ʿAlī ibn Budhaymah asserted, as mentioned earlier, and he is one of its narrators, and the narrator knows better about what he narrates than others. And Allāh knows best.
قلت: والراجح: أنه الطبل لجزم علي بن بذيمة به كما تقدم وهو أحد رواته والراوي أدرى بمرويه من غيره. والله أعلم.

"The previously married woman has more right over herself than her guardian, and the virgin's father must seek her permission regarding herself, and her permission is her silence." Narrated by Muslim (4/141), Abū Dāwūd (1/327), al-Nasāʾī (2/78), al-Dāraquṭnī (390), Aḥmad (1/219), and al-Ṭabarānī (no. 10745) through the route of Sufyān ibn ʿUyaynah from Ziyād ibn Saʿd from ʿAbd Allāh ibn al-Faḍl from Nāfiʿ ibn Jubayr from Ibn ʿAbbās, attributed to the Prophet. This isnād is authentic, but the mention of the father in this text has been criticized. Abū Dāwūd said: "The mention of her father is not preserved." Al-Dāraquṭnī said: "We do not know anyone who agreed with Ibn ʿUyaynah on this wording, and perhaps he mentioned it from memory, and his tongue slipped." I said: The preserved wording is: "She is consulted regarding herself," as has been previously narrated by Mālik from Ibn al-Faḍl, under number (1216).
- " الثيب أحق بنفسها من وليها، والبكر يستأذنها أبوها في نفسها وإذنها صماتها ". رواه مسلم (٤ / ١٤١) وأبو داود (١ / ٣٢٧) والنسائي (٢ / ٧٨) والدارقطني (٣٩٠) وأحمد (١ / ٢١٩) والطبراني (رقم ١٠٧٤٥) من طريق سفيان ابن عيينة عن زياد بن سعد عن عبد الله بن الفضل عن نافع بن جبير عن ابن عباس مرفوعا به. وهذا إسناد صحيح لكن ذكر الأب في هذا المتن قد أعلوه، فقال أبو داود: " أبوها ليس بمحفوظ ". وقال الدارقطني: " لا نعلم أحد وافق ابن عيينة على هذا اللفظ ولعله ذكره من حفظه فسبقه لسانه ". قلت: والمحفوظ بلفظ: " تستأمر في نفسها " وقد مضى من رواية مالك عن ابن الفضل به برقم (١٢١٦).

"The previously married couple are flogged and stoned, and the unmarried couple are flogged and exiled." Narrated by Abū Nuʿaym in "Masānīd Abī Yaḥyá Firās" (91/1) and al-Daylamī (2/70) from al-Ḥākim from Sharīk from Firās from al-Shaʿbī from Masrūq from Ubayy ibn Kaʿb, attributed to the Prophet. I said: This isnād is good for supporting evidence; its men are trustworthy, except that Sharīk, who is Ibn ʿAbd Allāh the judge, has poor memory. However, his ḥadīth is supported by what is found in Muslim and others from ʿUbādah ibn al-Ṣāmit, attributed to the Prophet, with the wording:
- " الثيبان يجلدان ويرجمان، والبكران يجلدان وينفيان ". أخرجه أبو نعيم في " مسانيد أبي يحيى فراس " (٩١ / ١) والديلمي (٢ / ٧٠) عن الحاكم عن شريك عن فراس عن الشعبي عن مسروق عن أبي بن كعب مرفوعا. قلت: وهذا إسناد جيد في الشواهد، رجاله ثقات لولا أن شريكا وهو ابن عبد الله القاضي سيء الحفظ. لكن يشهد لحديثه ما عند مسلم وغيره من عبادة بن الصامت مرفوعا بلفظ:
