the sky, and if it were not for the animals, they would not be given rain. They do not break the covenant of Allāh and the covenant of His Messenger except that Allāh will empower an enemy over them from others who will take some of what is in their hands. And their leaders do not judge by the Book of Allāh and choose from what Allāh has revealed except that Allāh will cause conflict among them." It was narrated by Ibn Mājah (4019) and Abū Nuʿaym in "al-Ḥilyah" (8/333-334) from Ibn Abī Mālik, from his father, from ʿAṭāʾ ibn Abī Rabāḥ, from ʿAbd Allāh ibn ʿUmar who said: The Messenger of Allāh (ṣallá Allāhu ʿalayhi wa-sallam) approached and said: and he mentioned it. I said: This isnād is weak due to Ibn Abī Mālik, whose name is Khālid ibn Yazīd ibn ʿAbd al-Raḥmān ibn Abī Mālik, and he is weak despite being a jurist, and Ibn Maʿīn accused him as mentioned in "al-Taqrīb." Al-Būṣīrī said in "al-Zawāʾid": "This ḥadīth is suitable for acting upon, and there was disagreement regarding Ibn Abī Mālik and his father." I said: The father is acceptable, but the defect is from his son, and thus al-Ḥāfiẓ Ibn Ḥajar indicated the weakness of the ḥadīth in "Badh al-Maʿūn" by saying (Q 55/2): "If the report is confirmed." I said: It is certainly confirmed as it came through other routes from ʿAṭāʾ and others. It was narrated by Ibn Abī al-Dunyā in "al-ʿUqūbāt" (Q 62/2) through the route of Nāfiʿ ibn ʿAbd Allāh from Furwah ibn Qays al-Makkī from ʿAṭāʾ ibn Abī Rabāḥ with it. I said: This isnād is weak; Nāfiʿ and Furwah are unknown as in "al-Mīzān." And it was narrated by al-Ḥākim (4/540) through the route of Abū Maʿbad Ḥafṣ ibn Ghaylān from ʿAṭāʾ
السماء ولولا البهائم لم يمطروا ولم ينقضوا عهد الله وعهد رسوله إلا سلطالله عليهم عدوا من غيرهم فأخذوا بعض ما في أيديهم وما لم تحكم أئمتهم بكتابالله ويتخيروا مما أنزل الله إلا جعل الله بأسهم بينهم ".رواه ابن ماجه (٤٠١٩) وأبو نعيم في " الحلية " (٨ / ٣٣٣ - ٣٣٤) عنابن أبي مالك عن أبيه عن عطاء بن أبي رباح عن عبد الله ابن عمر قال:أقبل رسول الله ﷺ فقال: فذكره.قلت: وهذا سند ضعيف من أجل ابن أبي مالك واسمه خالد بن يزيد بن عبد الرحمنابن أبي مالك وهو ضعيف مع كونه فقيها وقد اتهمه ابن معين كما في " التقريب ".وقال البوصيري في " الزوائد "." هذا حديث صالح للعمل به، وقد اختلفوا في ابن أبي مالك وأبيه ".قلت الأب لا بأس به، وإنما العلة من ابنه، ولذلك أشار الحافظ ابن حجر في" بذل الماعون " لضعف الحديث بقوله (ق ٥٥ / ٢) :" إن ثبت الخبر ".قلت: قد ثبت حتما فإنه جاء من طرق أخرى عن عطاء وغيره، فرواه ابن أبي الدنيافي " العقوبات " (ق ٦٢ / ٢) من طريق نافع بن عبد الله عن فروة بن قيس المكيعن عطاء بن أبي رباح به.قلت: وهذا سند ضعيف، نافع وفروة لا يعرفان كما في " الميزان ".ورواه الحاكم (٤ / ٥٤٠) من طريق أبي معبد حفص بن غيلان عن عطاء
