and Abū Nuʿaym from Zayd ibn al-Ḥawārī from him, and its narrators are trustworthy except for Zayd, who is weak.

"The woman has more right to her child as long as she does not remarry." It was extracted by al-Dāraqutnī in "Sunan" (418) through the path of al-Muthanná ibn al-Ṣabāḥ from ʿAmr ibn Shuʿayb from his father from his grandfather. "A woman disputed with her husband over her child, and the Prophet (ṣallá Allāhu ʿalayhi wa-sallam) said..." and he mentioned it. ʿAbd al-Razzāq also narrated it in "Muṣannaf": al-Muthanná ibn al-Ṣabāḥ informed us of it. And from ʿAbd al-Razzāq, it was narrated by Isḥāq ibn Rāhwayh in "Musnad" as in "Naṣb al-Rāyah" (3/265). Al-Ḥāfiẓ said in "al-Talkhīṣ" (4/11): "Al-Muthanná ibn al-Ṣabāḥ is weak. It is strengthened by what ʿAbd al-Razzāq narrated from al-Thawrī from ʿĀṣim from ʿIkrimah who said: 'A woman disputed with ʿUmar to Abū Bakr, and he had divorced her. Abū Bakr said: She is more affectionate, kinder, more merciful, more compassionate, and more tender-hearted, and she has more right to her child as long as she does not remarry.'" I say: And this, despite being mawqūf, is mursal, and it has been narrated through other mursal paths in "al-Muwaṭṭaʾ" and "Muṣannaf" of Ibn Abī Shaybah, and through another connected path with a weak, disconnected isnād, and I have compiled all of this in "Irwāʾ al-Ghalīl" (2250). Therefore, I see that strengthening the ḥadīth with this mawqūf is not strong; it is better to strengthen it by the fact that al-Muthanná has been followed up by more than one, as Ibn Jurayj followed him at Aḥmad (2/182) and al-Dāraqutnī, and al-Awzāʿī at Abū Dāwūd (2276) and al-Ḥākim (2/207), both from ʿAmr ibn Shuʿayb from his father from his grandfather ʿAbd Allāh ibn
" المرأة أحق بولدها ما لم تزوج ". أخرجه الدارقطني في " سننه " (٤١٨) من طريق المثنى بن الصباح عن عمرو ابن شعيب عن أبيه عن جده. " أن امرأة خاصمت زوجها في ولدها، فقال النبي ﷺ ... ". فذكره. وكذلك رواه عبد الرزاق في " مصنفه ": أخبرنا المثنى بن الصباح به. وعن عبد الرزاق رواه إسحاق بن راهويه في " مسنده " كما في " نصب الراية " (٣ / ٢٦٥). قال الحافظ في " التلخيص " (٤ / ١١) :" والمثنى بن الصباح ضعيف. ويقويه ما رواه عبد الرزاق عن الثوري عن عاصم عن عكرمة قال: " خاصمت امرأة عمر عمر إلى أبي بكر، وكان طلقها، فقال أبو بكر: هي أعطف وألطف وأرحم وأحن وأرأف، وهي أحق بولدها ما لم تتزوج ". أقول: وهذا مع كونه موقوفا، فهو مرسل، وقد روي من وجوه أخرى مرسلا في " الموطأ " و " المصنف " لابن أبي شيبة ومن وجه آخر موصولا بإسناد ضعيف منقطع وقد خرجت ذلك كله في " إرواء الغليل " (٢٢٥٠). ولذلك فإني أرى أن تقوية الحديث بهذا الموقوف ليس بالقوي، فالأولى تقويته بأن المثنى قد توبع عليه من غير واحد، فتابعه ابن جريج عند أحمد (٢ / ١٨٢) والدارقطني، والأوزاعي عند أبي داود (٢٢٧٦) والحاكم (٢ / ٢٠٧) كلاهما عن عمرو بن شعيب عن أبيه عن جده عبد الله بن.
