This is the correct view held by the majority of scholars from the jurists, the scholars of uṣūl, and all the muḥaddithīn, though some deviated by saying: this wording and its like are mawqūf; due to the possibility that the one commanding was not the Messenger of Allāh (ṣallá Allāhu ʿalayhi wa-sallam). This is incorrect, and the correct view is that it is marfūʿ; because such a statement inherently refers to the one who gives commands and prohibitions, who is the Messenger of Allāh (ṣallá Allāhu ʿalayhi wa-sallam)." I say: the statement of Abū Ḥumayd: "He commanded" is like the statement of Anas with no difference, thus it is considered marfūʿ. Even more explicit is the narration of Ibn Ḥibbān (1267) with the wording: "We were only commanded..."
تحقيق الأخ الفاضل عبد الباري السلفي) ، وضربوا لذلك مثلاً بحديث أنس: "أمر بلال أن يشفع الأذان، ويوتر الإقامة". متفق عليه، وهو مخرج في "صحيح أبي داود" (٥٢٥) . بل قال النووي في شرحه على "صحيح مسلم ":"وقوله: "أُمر" هو بضم الهمزة وكسر الميم؛ أي: أمره رسول الله ﷺ، هذا هو الصواب الذي عليه جمهور العلماء من الفقهاء وأصحاب الأصول وجميع المحدثين، وشذ بعضهم فقال: هذا اللفظ وشبهه موقوف؛ لاحتمال أن يكون الآمر غير رسول الله ﷺ. وهذا خطأ، والصواب أنه مرفوع؛ لأن إطلاق ذلك إنما ينصرف إلى صاحب الأمر والنهي، وهو رسول الله ﷺ ". قلت: فقول أبي حميد: "أمر" كقول أنس ولا فرق، فهو- إذن- في حكم المرفوع. وأصرح منه رواية ابن حبان (١٢٦٧) بلفظ:"إنما كنا نؤمر.. ".
