it was recorded by al-Dāraqutnī (4/252/32) through two paths from Manṣūr with it. I said: This is a sound isnād, all its men are trustworthy, the men of the authentic collections, and Qazaʿah is Ibn Yaḥyá al-Baṣrī. It has a mursal witness narrated by al-Awzāʿī: Muḥammad ibn Abī Mūsá told me that he heard al-Qāsim ibn Mukhaimarah informing: that Abū Mūsá al-Ashʿarī (raḍiya Allāhu ʿanhu) brought to the Prophet (ṣallá Allāhu ʿalayhi wa-sallam) a jar of nabīdh that was fermenting, and he said: "Throw it against the wall..." and the ḥadīth is similar. It was recorded by Abū Yaʿlá (13/7259), Aḥmad (89/239), and al-Bayhaqī, who said: "If there was a way to make it permissible by pouring water on it, he would not have ordered its disposal. And Allāh knows best." I said: It is a strong mursal isnād, which adds strength to the ḥadīth, and al-Nasāʾī indicated that it is authentic according to him; he said after it: "In this is evidence of the prohibition of intoxication, whether in small or large amounts, and it is not as those who deceive themselves claim by prohibiting the last sip and permitting what precedes it, which is drunk in the vessel before it. There is no disagreement among the scholars that intoxication in its entirety does not occur with the last sip without the first and second after it, and with Allāh is success." Abū al-Ḥasan al-Sindī al-Ḥanafī agreed with him in his "Commentary" on it, saying: "It is the relied upon opinion among our Ḥanafī scholars, and reliance on the opinion that the prohibited is the intoxicating sip, and what was before it is permissible, has been refuted by the researchers; as the author, may Allāh have mercy on him, refuted it." *
أخرجه الدارقطني (٤/٢٥٢/٣٢) من طريقين عن منصور به. قلت: وهذا إسناد صحيح، رجاله كلهم ثقات رجال الصحيح، وقزعة هو ابن يحيى البصري. وله شاهد مرسل يرويه الأوزاعي: حدثني محمد بن أبي موسى أنه سمع القاسم بن مخيمرة يخبر:أن أبا موسى الأشعري ﵁ أتى النبي ﷺ بنبيذ جَرٍّ ينِشُّ فقال: "اضرب به الحائط.. " الحديث مثله. أخرجه أبو يعلى (١٣/ ٧٢٥٩) ، وأحمد (٨٩/٢٣٩) ، والبيهقي، وقال:"ولو كان إلى إحلاله- بصب الماء عليه- سبيل؛ لما أمر بإراقته. والله أعلم ". قلت: وهو مرسل قوي الإسناد، فيزداد به الحديث قوة على قوة، وقد أشار النسائي إلى أنه صحيح عنده؛ فقال عقبه:"وفي هذا دليل على تحريم السكر قليله وكثيره، وليس كما يقول المخادعون لأنفسهم بتحريمهم آخر الشربة، وتحليلهم ما تقدمها الذي يشرب في الفَرَق قبلها. ولا خلاف بين أهل العلم أن السكر بكليته لا يحدث على الشربة الأخيرة دون الأولى والثانية بعدها، وبالله التوفيق ". ووافقه أبو الحسن السندي الحنفي في "حاشيته " عليه، فقال:"وهو المعتمد عند علمائنا الحنفية، والاعتماد على القول بأن المحرم هو الشربة المسكرة، وما كان قبلها فحلال قد ردّه المحققون؛ كما رده المصنف رحمه الله تعالى". *
