there is another path of exception from Abū Hurayrah, narrated by Ḥammād ibn Salamah from Abū al-Muhzam from him, who said: "The price of a dog is prohibited, except for a hunting dog." It was recorded by al-Tirmidhī (1281) who said: "It is not authentic from this perspective, and Abū al-Muhzam's name is Yazīd ibn Sufyān, and Shuʿbah criticized him and declared him weak. It has also been narrated from Jābir from the Prophet (ṣallá Allāhu ʿalayhi wa-sallam) similar to this, and its isnād is also not authentic." Abū al-Muhzam is abandoned as mentioned in "al-Taqrīb," so he is not used as evidence, and "al-Talkhīṣ" suffices with saying about him (3/4): "He is weak." I say: Ḥammād ibn Salamah has another isnād, which he narrates from Abū al-Zubayr from Jābir in a marfūʿ form similar to it. This is what al-Tirmidhī referred to and declared weak. It is extracted under the authentic ḥadīth mentioned earlier, number (2971), by al-Nasāʾī, and he also declared it weak. As al-Ḥāfiẓ said: "Its narrators are trustworthy," and it includes the ʿanʿanah of Abū al-Zubayr as you see. There is a disagreement in its isnād on Ḥammād, whether it is marfūʿ, mawqūf, or mursal, and al-Dāraqutnī said: "The mawqūf is more authentic." I did not find anything to support it, especially since it was narrated by al-Ḥasan ibn Abī Jaʿfar from Abū al-Zubayr from Jābir in a marfūʿ form. It was recorded by al-Dāraqutnī (274), and al-Bayhaqī commented on it, saying: "Al-Ḥasan ibn Abī Jaʿfar is not strong."
وللاستثناء عن أبي هريرة طريق أخرى، يرويها حماد بن سلمة عنأبي المهزم عنه قال: " نهي عن ثمن الكلب، إلا كلب الصيد ". أخرجه الترمذي (١٢٨١) وقال: " لا يصح من هذا الوجه، وأبو المهزم اسمه يزيد بن سفيان،وتكلم فيه شعبة وضعفه. وقد روي عن جابر عن النبي ﷺ نحو هذا، ولا يصح إسناده أيضا ". وأبو المهزم متروك كما في " التقريب "، فلايستشهد به، واقتصر في " التلخيص " على قوله فيه (٣ / ٤) : " وهو ضعيف ". قلت: ولحماد بن سلمة إسناد آخر يرويه عن أبي الزبير عن جابر مرفوعا مثله.وهو الذي أشار إليه الترمذي وضعفه. وهو مخرج تحت الحديث الصحيح المتقدم برقم(٢٩٧١) برواية النسائي، وضعفه أيضا. وهو كما قال الحافظ: " رجاله ثقات "، وفيه عنعنة أبي الزبير كما ترى. وقد اختلف في إسناده على حماد رفعا ووقفاوإرسالا، وقال الدارقطني: " والموقوف أصح ". ولم أجد ما يؤيده، لاسيماوقد رواه الحسن بن أبي جعفر عن أبي الزبير عن جابر مرفوعا. أخرجه الدارقطني (٢٧٤) ، وعلقه البيهقي، وقال: " الحسن بن أبي جعفر ليس بالقوي ".
