and the ḥadīth has a corroborating report that is mawqūf, narrated by al-Aʿmash from Ibrāhīm that ʿUmar ibn al-Khaṭṭāb said regarding the mutual imprecators: once they have invoked curses, they are to be separated and never reunited. It was recorded by ʿAbd al-Razzāq and al-Bayhaqī. I said: Its narrators are reliable, but it is disconnected between Ibrāhīm—who is al-Nakhaʿī—and ʿUmar ibn al-Khaṭṭāb. If you understand what has been mentioned, the ḥadīth is valid for use as evidence that the separation due to mutual imprecation is an annulment. This is the view of al-Shāfiʿī, Aḥmad, and others, while Abū Ḥanīfah held that it is an irrevocable divorce, and the ḥadīth refutes him. Mālik, al-Thawrī, Abū ʿUbaydah, and Abū Yūsuf also adopted this view, and it is the truth that is necessitated by sound reasoning regarding the wisdom behind their separation, as explained by Ibn al-Qayyim, may Allāh have mercy on him, in "Zād al-Maʿād," so refer to it (4/151 and 153-154). This view is also inclined towards by al-Ṣanʿānī in "Subul al-Salām" (3/241).
وللحديث شاهد موقوف يرويه الأعمش عن إبراهيم أن عمر بن الخطاب قال فيالمتلاعنين إذا تلاعنا: يفرق بينهما، ولا يجتمعان أبدا. أخرجه عبد الرزاق،والبيهقي. قلت: ورجاله موثقون، لكنه منقطع بين إبراهيم - وهو النخعي -وعمر بن الخطاب. إذا علمت ما تقدم فالحديث صالح للاحتجاج به على أن فرقة اللعانإنما هي فسخ، وهو مذهب الشافعي وأحمد وغيرهما، وذهب أبو حنيفة إلى أنهطلاق بائن، والحديث يرد عليه، وبه أخذ مالك أيضا والثوري وأبو عبيدةوأبو يوسف، وهو الحق الذي يقتضيه النظر السليم في الحكمة من التفريق بينهما،على ما شرحه ابن القيم رحمه الله تعالى في " زاد المعاد " فراجعه (٤ / ١٥١و١٥٣ - ١٥٤) وإليه مال الصنعاني في " سبل السلام " (٣ / ٢٤١) .
- "He would not recite the Qurʾān in less than three days." It was recorded by Ibn Saʿd in "al-Ṭabaqāt" (1/376): Yūsuf ibn al-Gharaq narrated to us, al-Ṭayyib ibn Sulaymān informed us, ʿAmrah narrated to us, she said: I heard ʿĀʾishah (raḍiya Allāhu ʿanhā) say: and she mentioned it. It was also recorded by Abū Shaykh in "Akhlaq al-Nabī ﷺ" (p. 280-281) through another chain from Yūsuf ibn al-Gharaq. I said: This isnād has weakness, as Yūsuf, about whom Ibn Abī Ḥātim said (4/2/227-228): "I asked my father about him? He said: He is not strong. I heard my father say: Aḥmad ibn Ḥanbal said:
- " كان لا يقرأ القرآن في أقل من ثلاث ".أخرجه ابن سعد في " الطبقات " (١ / ٣٧٦) : أخبرنا يوسف بن الغرق أخبرنا الطيببن سليمان حدثتنا عمرة قالت: سمعت عائشة ﵂ تقول: فذكره. وأخرجه أبو الشيخ في " أخلاق النبي ﷺ " (ص ٢٨٠ - ٢٨١) منطريق أخرى عن يوسف بن الغرق به. قلت: وهذا إسناد فيه ضعف، يوسف هذا، قالابن أبي حاتم (٤ / ٢ / ٢٢٧ - ٢٢٨) : " سألت أبي عنه؟ فقال: ليس بالقوي،سمعت أبي يقول: قال أحمد بن حنبل:
