"If the newborn cries, he inherits." Narrated by Abū Dāwūd (2920) from Muḥammad ibn Isḥāq from Yazīd ibn ʿAbd Allāh ibn Qusaiṭ from Abū Hurayrah in a marfūʿ form. And from Abū Dāwūd, it was narrated by al-Bayhaqī (6/257) and he mentioned that Ibn Khuzaymah also reported it from this chain. I say: Its narrators are trustworthy, except that Ibn Isḥāq is known for tadlīs, and he narrated it with ʿanʿanah. However, it has a corroborating narration from Jābir in a marfūʿ form. Narrated by Ibn Mājah (2750) from al-Rabīʿ ibn Badr who reported from Abū al-Zubayr from him. I say: Al-Rabīʿ ibn Badr is abandoned, but he was followed by al-Mughīrah ibn Muslim and Sufyān from Abū al-Zubayr with it. Al-Ḥākim reported it (4/348, 349) and said: "Authentic according to the conditions of the two Shaykhs." Al-Dhahabī agreed with him. I say: Rather, it is according to the condition of Muslim only, considering that Abū al-Zubayr is known for tadlīs and he narrated it with ʿanʿanah. It has a corroborating narration from Ibn ʿAbbās in a marfūʿ form. Reported by Ibn ʿAdī (Q 193/1) through the route of Sharīk from Abū Isḥāq from ʿAṭāʾ from him. I say: This chain is acceptable for supporting evidence, as Sharīk is Ibn ʿAbd Allāh al-Qāḍī, who is trustworthy but has poor memory, and similarly Abū Isḥāq al-Sabīʿī, as he experienced confusion. (Benefit) In the ḥadīth of Jābir and al-Miswar mentioned earlier, the crying of the child is explained by saying: "That he cries, sneezes, or weeps." It is an authentic ḥadīth as mentioned earlier, so do not be deceived by the statement of al-Ṣanʿānī
