I said: he is reliable, but he had become confused, and al-Thawrī disagreed with him, saying: from Wāʾil ibn Dāwūd from Saʿīd ibn ʿUmayr from his uncle. It was recorded by al-Ḥākim, who said: "The isnād is authentic." Al-Dhahabī agreed with him. The second [narration] is from Ibn ʿUmar, narrated by al-Ṭabarānī in "al-Awsaṭ" from al-Ḥasan ibn ʿArafah, who reported to us from Qudāmah ibn Shihāb al-Māzinī, who reported to us from Ismāʿīl ibn Abī Khālid from Wabarah ibn ʿAbd al-Raḥmān from Ibn ʿUmar as a marfūʿ ḥadīth, and he said: "No one narrated it from Ismāʿīl except Qudāmah, and al-Ḥasan ibn ʿArafah was unique in narrating it." I said: he is acceptable, and the rest of the narrators are reliable, so the isnād is authentic, if Allāh wills. Al-Mundhirī said (3/3) and was followed by al-Haythamī (4/61): "It was narrated by al-Ṭabarānī in 'al-Kabīr' and 'al-Awsaṭ,' and its narrators are reliable." It was also narrated by Sharīk from Wāʾil ibn Dāwūd from Jamīʿ ibn ʿUmayr from his maternal uncle Abū Burdah as a marfūʿ ḥadīth. It was recorded by Aḥmad (3/466) and also by al-Ḥākim, and this is another disagreement regarding Wāʾil, and al-Ḥākim said: "When al-Thawrī and Sharīk disagree, the ruling is in favor of al-Thawrī." I said: and this is without doubt, for Sharīk has poor memory, while al-Thawrī is a reliable, preserving imām, and thus it does not harm him that others, besides Sharīk, disagree with him. Abū ʿUbayd said in "Gharīb al-Ḥadīth" (Q 121/2): Abū Muʿāwiyah and Marwān ibn Muʿāwiyah both narrated from Wāʾil ibn Dāwūd from Saʿīd ibn ʿUmayr, saying: the Prophet (ṣallá Allāhu ʿalayhi wa-sallam) was asked... and he mentioned it as mursal without mentioning in its isnād "from his uncle," which is a correct addition in al-Thawrī's narration, even though al-Bayhaqī criticized it as transmitted by al-Mundhirī from him. And Allāh knows best. Then I saw in "al-ʿIlal" by Ibn Abī Ḥātim, he said (2/443):
قلت: وهو ثقة لكنه كان قد اختلط وقد خالفه الثوري فقال: عن وائل بن داود عن سعيد بن عمير عن عمه. أخرجه الحاكم وقال: " صحيح الإسناد ". ووافقه الذهبي. الثاني عن ابن عمر، رواه الطبراني في " الأوسط " عن الحسن بن عرفة حدثنا قدامة بن شهاب المازني حدثنا إسماعيل بن أبي خالد عن وبرة بن عبد الرحمن عن ابن عمر مرفوعا به وقال: " لم يروه عن إسماعيل إلا قدامة تفرد به الحسن بن عرفة ". قلت: وهو لا بأس به وبقية رجاله ثقات، فالسند صحيح إن شاء الله. وقال المنذري (٣ / ٣) وتبعه الهيثمي (٤ / ٦١) : " رواه الطبراني في " الكبير " و " الأوسط "، ورجاله ثقات ". وقد رواه شريك عن وائل بن داود عن جميع بن عمير عن خاله أبي بردة مرفوعا به. أخرجه أحمد (٣ / ٤٦٦) والحاكم أيضا وهذا خلاف آخر على وائل وقال الحاكم: " وإذا اختلف الثوري وشريك فالحكم للثوري ". قلت: وهذا مما لا ريب فيه، فإن شريكا سيء الحفظ، والثوري ثقة حافظ إمام ولذلك فلا يضره مخالفة غير شريك إياه، فقد قال أبو عبيد في " غريب الحديث " (ق ١٢١ / ٢) : حدثنا أبو معاوية ومروان بن معاوية كلاهما عن وائل بن داود عن سعيد بن عمير قال: سئل النبي ﷺ ... فذكره مرسلا لم يذكر في إسناده " عن عمه " وهي زيادة صحيحة لرواية الثوري لها وإن خطأها البيهقي كما نقله المنذري عنه. والله أعلم. ثم رأيت في " العلل " لابن أبي حاتم قال (٢/ ٤٤٣) :
