like a foundation for it and like a conclusion that seals the discussion: it provides the most decisive judgment, the highest proclamation, the clearest indication, and the most evident message: that what the author of "al-Baḥr" narrated from Imām Yaḥyá is a mistake among the mistakes of scholars, an error similar to what occurs to the mujtahids, and this is the nature of human beings. The one who is protected is the one whom Allāh protects. Every scholar's words are taken or left, despite him being one of the greatest imāms in fairness, most diligent in seeking the truth, guidance, and influence. However, we found that he differed from others with his statement: permitting the building of domes over graves. We referred this difference to what Allāh has commanded us to refer to. which is the Book of Allāh and the sunnah of His Messenger (ṣallá Allāhu ʿalayhi wa-sallam). We found therein what we have previously mentioned of evidence that indicates most clearly, proclaiming loudly the prohibition of that and the forbiddance of it, the curse upon its doer, and the supplication against him. and the severe wrath of Allāh upon him, along with it being a means to shirk and a way to exit the religion as we have explained. If the one who said what Imām Yaḥyá said were some or most of the imāms, their statement would be refuted, as we presented at the beginning of this discussion. So how is it when the one who said it is just an individual among them? It has been authentically reported from the Messenger of Allāh (ṣallá Allāhu ʿalayhi wa-sallam) that he said: "Every matter that is not in accordance with our affair is rejected," and raising graves and building domes and mosques over them is not in accordance with the affair of the Messenger of Allāh (ṣallá Allāhu ʿalayhi wa-sallam), as we have informed you, so it is rejected upon its proponent, meaning it is refuted. The one who legislated this Islamic sharīʿah for the people is the Lord, glorified be He, through what He revealed in His Book and on the tongue of His Messenger (ṣallá Allāhu ʿalayhi wa-sallam)
كالتوطيد لها وما هو كالخاتمة تختم بها البحث: يقضي أبلغ قضاء وينادي أرفع نداء، ويدل أوضح دلالة، ويفيد أجلى مفاد: أن ما رواه صاحب البحر عن الإمام يحيى، غلط من أغاليط العلماء، وخطأ من جنس ما يقع للمجتهدين وهذا شأن البشر. والمعصوم من عصمه الله. وكل عالم يؤخذ من قوله ويترك، مع كونه ﵀ من أعظم الأئمة إنصافا وأكثرهم تحريا للحق وإرشادا وتأثيرا، ولكننا رأيناه قد خالف من عداه بما قال: من جواز بناء القباب على القبور رددنا هذا الاختلاف إلى ما أوجب الله الرد إليه. وهو كتاب الله وسنة رسوله ﷺ. فوجدنا في ذلك ما قدمنا ذكره من الأدلة الدالة أبلغ دلالة، والمنادية بأعلى صوت بالمنع من ذلك والنهي عنه، واللعن لفاعله والدعاء عليه. واشتداد غضب الله عليه، مع ما في ذلك من كونه ذريعة إلى الشرك، ووسيلة إلى الخروج عن الملة كما أوضحناه. فلو كان القائل بما قاله الإمام يحيى بعض الأئمة أو أكثرهم لكان قولهم ردا عليهم، كما قدمناه في أول هذا البحث. فكيف والقائل به فرد من أفرادهم؟ وقد صح عن رسول الله ﷺ أنه قال: "كل أمر ليس عليه أمرنا فهو رد"، ورفع القبور وبناء القباب والمساجد عليها ليس عليها أمر رسول الله ﷺ، كما عرفناك ذلك فهو رد على قائله، أي مردود عليه. والذي شرع للناس هذه الشريعة الإسلامية هو الرب سبحانه بما أنزله في كتابه وعلى لسان رسوله ﷺ.
