any elevated grave without leveling it." In Ṣaḥīḥ Muslim, there is also a narration from Thumāmah ibn Shafīʿ similar to that. This is a strong indication that leveling every elevated grave that rises beyond the prescribed amount is an obligatory duty. Among the forms of elevated graves are those whose height is raised, or domes or mosques are built over them. This is undoubtedly and unquestionably prohibited. For this reason, the Prophet (ṣallá Allāhu ʿalayhi wa-sallam) sent the Commander of the Faithful, ʿAlī, to demolish them. Then, the Commander of the Faithful sent Abū al-Hayyāj al-Asadī to demolish them during his caliphate. Aḥmad, Muslim, Abū Dāwūd, and al-Tirmidhī, who authenticated it, as well as al-Nasāʾī and Ibn Ḥibbān, narrated from the ḥadīth of Jābir who said: "The Messenger of Allāh (ṣallá Allāhu ʿalayhi wa-sallam) forbade plastering the grave, building over it, and treading upon it." These narrators added to this ḥadīth from Muslim, "and writing on it." Al-Ḥākim said: The prohibition of writing is according to the conditions of Muslim, and it is authentic and rare. This explicitly prohibits building over graves, which applies to what is built on the sides of the grave pit, as many people do by raising the graves of the deceased a cubit or more. Because it is not possible to make the grave itself a mosque, this indicates that the intention is some of what is close to it and connected to it
