It was recorded by Aḥmad (5/382) and its chain is authentic according to the criteria of al-Shaykhayn. Al-Bukhārī also recorded it (6314) without mentioning "the right hand," as did al-Tirmidhī (3395), who said: "A ḥadīth that is ḥasan ṣaḥīḥ." This addition was overlooked by the ḥāfiẓ, so he did not attribute it to Aḥmad!
أخرجه أحمد (٥ / ٣٨٢) وإسناده صحيح على شرط الشيخين، وقد أخرجه البخاري (٦٣١٤) دون ذكر " اليمنى "، وكذا الترمذي (٣٣٩٥) وقال: " حديث حسن صحيح ". وخفيت هذه الزيادة على الحافظ فلم يعزها لأحمد!

"His statement: *And whoever does not judge by what Allāh has revealed, then it is they who are the disbelievers*; *And whoever does not judge by what Allāh has revealed, then it is they who are the wrongdoers*; *And whoever does not judge by what Allāh has revealed, then it is they who are the defiantly disobedient*; he said: it is all about the disbelievers." It was recorded by Aḥmad (4/286): Abū Muʿāwiyah narrated to us, al-Aʿmash narrated from ʿAbdullāh ibn Murrah from al-Barāʾ ibn ʿĀzib from the Prophet (ṣallá Allāhu ʿalayhi wa-sallam) his statement: ... I said: And this chain is authentic according to the criteria of al-Shaykhayn. The ḥadīth is explicit evidence that these three verses refer to the disbelievers among the Jews and Christians and their likes who deny the Islamic sharīʿah and its rulings. It includes anyone who shares in this, even if they outwardly profess Islam, even if they deny just one ruling. However, it is important to be aware that this does not apply to someone who does not judge by any of it without denying it. It is not permissible to judge such a person as a disbeliever and as having left the faith because he is a believer; the most that can be said is that his disbelief is practical disbelief. " قوله: * (ومن لم يحكم بما أنزل الله فأولئك هم الكافرون) *، * (ومن لم يحكم بما أنزل الله فأولئك هم الظالمون) *، * (ومن لم يحكم بما أنزل الله فأولئك هم الفاسقون) *، قال: هي في الكفار كلها ". أخرجه أحمد (٤ / ٢٨٦) : حدثنا أبو معاوية حدثنا الأعمش عن عبد الله بن مرة عن البراء بن عازب عن النبي ﷺ قوله: ... قلت: وهذا إسناد صحيح على شرط الشيخين. والحديث دليل صريح في أن المقصود بهذه الآيات الثلاث الكفار من اليهود والنصارى وأمثالهم الذين ينكرون الشريعة الإسلامية وأحكامها، ويلحق بهم كل من شاركهم في ذلك ولو كان يتظاهر بالإسلام، حتى ولو أنكر حكما واحدا منها. ولكن مما ينبغي التنبه له، أنه ليس كذلك من لا يحكم بشيء منها مع عدم إنكاره ذلك، فلا يجوز الحكم على مثله بالكفر وخروجه عن الملة لأنه مؤمن، غاية ما في الأمر أن يكون كفره كفرا عمليا. وهذه نقطة هامة في هذه المسألة يغفل عنها كثير من الشباب المتحمس لتحكيم الإسلام، ولذلك فهم في كثير من الأحيان
